ACCEPTANCE OF TERMS CLAUSE
Updated as of September 29th, 2021
By purchasing and/or using my artwork, you accept and agree to be bound by the terms and
provision of this agreement. In addition, when purchasing and/or using my artwork, you shall be
subject to any posted guidelines or rules applicable, which may be posted and modified from
time to time. All such guidelines or rules are hereby incorporated by reference into my T&Cs
(Terms and Conditions).
ANY INTERACTIONS WITH ME OR MY ARTWORK WILL CONSTITUTE
ACCEPTANCE OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ABIDE BY THE
ABOVE AND BELOW, PLEASE DO NOT BUY OR USE MY ART.
TERMS AND CONDITIONS
1. PAYMENT AND REFUNDS
1.1. All payments must be completed before I start a commission. This includes
custom commissions and Your Character Here(YCH) commissions.
1.2. If I am being paid for an adoptable, I must be paid in full before I transfer the
artwork.
1.3. Payment will only be done through PayPal or other agreed means. This means
that I will not take any other sort of payment method, unless I agree to it.
1.4. Prices are not set permanently and may be subject to change.
1.5. NSFW (adult-themed) artwork is subject to higher pricing.
1.6. No refunds.
1.7. USD currency.
2. TRADES
2.1. I do not accept trades at this time.
3. YOUR USAGE RIGHTS
3.1. I will always hold the copyright to any artwork produced.
3.2. Do not remove my signature.
3.3. You may not alter the artwork that I produce in any fashion.
3.3.1. The only exception is if the client wishes to re-size the artwork.
3.4. I will always hold the copyright even if terms of service are violated and the
artwork is altered in any fashion. This is not permission to alter the work in any
form.
3.5. I am allowed to display work online and in offline spaces.
3.6. If I want to sell merchandise featuring the artwork, I will ask for and receive
permission in writing.
3.6.1. If contact has been lost with the commissioner I am allowed to sell the
artwork as merchandise after a wait period of one year since the
agreement date of the commission.
3.7. You are free to directly link your character's picture from my portfolio in your
character descriptions.
3.8. You may display the art on character profiles such as Toyhou.se, RPRepository,
personal websites for your character(s) and those of similar nature. Please credit
the creator (me) of those artworks and link back to my website.

3.9. You may not claim that you have made the artwork that I produce.
3.10. You may make prints and display my artwork in a fashion that you like if you have
paid for it.
3.10.1. You may not use my artwork for commercial use.
3.10.2. You may re-sell my artwork that you obtained with their rights, but you
may not sell additional merchandise, merchandise featuring the artwork,
or additional digital copies of the artwork.
3.10.3. If my work displays one or more of the commissioner's characters, they
are allowed to sell or trade it alongside the character. They adhere to the
same terms of service agreement. This means they are allowed to sell
their own copy of the art but nothing more.
3.11. You must make the buyer aware of their usage rights as well, should you choose
to sell my artwork.
3.12. I am not selling licenses to my work at this time.
4. CUSTOM COMMISSION PROCESS
4.1. Upon payment received your commission is officially started.
4.2. You enter the queue if I have one and other commissions ahead of you will be
finished first. First come, first serve.
4.3. When I begin your commission I will gather references as needed. This can take
one to two days.
4.4. When I have completed the initial sketch I will stop and show you the result so as
to make any adjustments. Adjustments are easiest to make at this stage and will
become harder to change as progress goes on. It is the client’s responsibility to
be comprehensive.
4.5. When the sketch is approved I will go to the next stage depending on what that
is. Art is subject to different needs in different circumstances and so this will be a
touch-and-go process. The next stage, upon completion, will be shown to the
client again for approval. Adjustments can still be made at this stage but they will
be harder to make. I reserve the right to decline anything I consider too difficult
to change.
4.6. This process will go for as long as needed until the final stage. The final stage
will follow a similar process in which I will show the client the artwork for
approval. Adjustments can only be made with touch-ups. Touch-ups are defined
as small incremental changes that do not involve major changes to the artwork.
4.7. By default the client will receive a .png file in 300dpi in pre-determined
dimensions. I usually work in 12x8 inch dimensions. The client will receive the
file via an e-mail attachment, Discord attachment, or other agreed upon delivery.
4.8. No do-overs.
4.9. You may check in on the progress once per week.
4.10. Belligerent exchange may result in cancelling the rest of your commission. You
will not get a refund.
4.11. My time table is defined as vague at this time. While I will do my best to keep a
steadfast schedule, I am enduring chronic illness and other life obstacles. I am
building my stamina at this time and I hope to understand a better definition of my
time table.
4.12. I won’t accept any deadlines you give me.
4.13. I will keep a steady pace on the work because I believe you deserve quality
artwork, and that takes time.
4.14. I cannot guarantee to produce precisely what your imagination desires to see.
There will always be variation between artists.
4.15. Please provide visual references and/or a comprehensive description for what
you want.
5. OTHER
5.1. This Terms of Service comes into effect on September 29th, 2021.
5.2. I reserve the right to show and display each commission/adoptable I produce
how I wish.
5.3. If I want to sell prints, I will ask permission to use the character and take it in
writing.
5.4. I reserve the right to decline an offer (as on an adopt) or a commission for any
reason.
5.5. I reserve the right to deny any request, trade, or commission for any reason.
5.6. I reserve the right to issue takedowns to any user and any site hosting my work
without my permission.
5.7. All of my work is in digital media.
5.7.1. As such, it is distributed to you only on the computer through private
messages or e-mail attachments. I do not ship the artwork to you.
5.7.2. All questions and concerns should be directed to me.
